Fighting Helps

Client A.H. today, received an offer of a "dry" reckless driving.  She has been fighting this for almost 2 years because a DUI or any alcohol related offense would have negative consequences on her career.  We tried this case to a jury and got a hung jury.  The DA would not make a better offer and she knew she wanted to fight again.  Fighting paid off, because, on the day of trial, the DA caved in and made a better offer, dry reckless, 1 year informal probation and a small fine.

In CA, 30% of all DUI arrests end up as something less!

I wish more clients would be as motivated to fight as A.H. was.  I keep telling clients that the DA's office expects people to roll over and enter a plea.  There is nothing wrong with fighting and there is a real chance that you will come out with a better deal.  If you plead guilty, you will be guilty.  Fighting is your only chance to end up with something better.
